Terms of Service

Terms of Use —
ListU Marketplace.

These Terms of Service govern your use of the ListU platform operated by Valentino Platinum Ltd(Companies House No. 07972278), registered in England and Wales. By accessing or using ListU, you agree to be bound by these terms. Please read them carefully before using the platform.

Definitions

"Platform"The ListU classified marketplace accessible at listu.co.uk, including all associated services, features, and content.
"Operator"Valentino Platinum Ltd, a private limited company registered in England and Wales (Co. No. 07972278), which owns and operates the Platform.
"User"Any individual or entity who accesses or uses the Platform, whether or not they have a registered account.
"Account"A registered user account on the Platform, classified as either a Private User account or a Business User account.
"Private User"A registered account type for individuals buying or selling in a personal capacity, not as part of a commercial activity.
"Business User"A registered account type for individuals or entities selling commercially — including traders, dealers, sole traders, and businesses.
"Listing"An advertisement for goods or services posted to the Platform by a registered User.
"Content"Any text, images, data, or other material submitted to the Platform by a User.
"Transaction"Any exchange, agreement, or payment made between Users in connection with a Listing.

Acceptance of Terms

By accessing or using the Platform in any way — including browsing listings, creating an account, posting a listing, or contacting another User — you confirm that you have read, understood, and agree to be bound by these Terms of Service and all applicable policies.

If you do not agree to these Terms, you must not use the Platform.

Capacity to contract

By using the Platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the Platform on behalf of a business or organisation, you confirm you have the authority to bind that entity to these Terms.

Business Users — additional obligations

If you register as or operate as a Business User, you acknowledge that you may be subject to additional obligations under applicable UK consumer protection and trading standards law, including the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008.

Accounts and Registration

Registration

Certain features of the Platform — including posting listings and contacting sellers — require a registered account. To register, you must provide accurate, current, and complete information.

Account classification

At registration, you must select your account type. You must choose Business User if you are selling or intending to sell goods or services commercially — including as a sole trader, dealer, or business — regardless of whether you are a formally registered company. Selecting Private User when you are in fact selling commercially is a breach of these Terms.

Account security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must not share your login credentials with any other person.
  • You must notify us immediately at support@listu.co.uk if you become aware of any unauthorised use of your account.
  • The Operator is not liable for any loss or damage arising from your failure to maintain account security.

Verification

Email verification is required before posting listings. Phone and ID verification are optional but increase your trust tier and posting limits. The Operator may require additional verification at its discretion.

One account per person

Each individual or entity may maintain only one active account on the Platform. Creating duplicate or multiple accounts to circumvent restrictions or bans is a breach of these Terms.

Listings and Content

Listing standards

All Listings posted to the Platform must comply with the ListU Listing Standards, available at listu.co.uk/listing-standards. By posting a Listing, you confirm the Listing complies with those standards and these Terms.

Accuracy

You must ensure that all Listings are accurate, complete, and not misleading. You must not post Listings for items you do not own or have the authority to sell, or for items that do not exist.

Prohibited listings

  • Items prohibited by UK law or regulation
  • Stolen or fraudulently obtained goods
  • Counterfeit, replica, or misrepresented goods
  • Dangerous goods or substances without appropriate licensing
  • Animals not compliant with the Pet Advertising Advisory Group (PAAG) standards where applicable
  • Financial products, loans, or investment opportunities
  • Adult content or services
  • Listings designed to mislead, defraud, or harm other Users

Listing limits

Daily listing limits and maximum listing values apply by trust tier. Current limits are available in your account settings. The Operator may adjust limits at any time.

Content licence

By posting Content to the Platform, you grant the Operator a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that Content for the purpose of operating and promoting the Platform. This licence ends when the Content is removed from the Platform.

Listing removal

The Operator reserves the right to remove any Listing that breaches these Terms, the Listing Standards, or any applicable law, at any time and without prior notice.

User Conduct

You must not use the Platform to:

  • Post false, misleading, or fraudulent Listings or communications
  • Harass, abuse, threaten, or intimidate other Users
  • Impersonate any person, entity, or the Operator
  • Harvest contact details or data from the Platform for any purpose
  • Send unsolicited commercial communications (spam) to other Users
  • Interfere with, disrupt, or damage the Platform or its infrastructure
  • Attempt to gain unauthorised access to any part of the Platform or any other User's account
  • Use automated scripts, bots, or scrapers on the Platform without written permission
  • Facilitate or encourage any illegal activity
  • Breach any applicable law or regulation

Reporting

If you become aware of any conduct that breaches these Terms, you should report it using the platform's reporting tools or by contacting safety@listu.co.uk. The Operator will investigate all reports but is not obliged to take any specific action.

Transactions Between Users

Platform role

ListU is a classified marketplace platform. The Operator facilitates connections between buyers and sellers but is not a party to any Transaction between Users. All Transactions are conducted directly between the relevant Users.

No payment processing

The Platform does not currently process payments between Users. All payment arrangements are made directly between buyer and seller outside the Platform. The Operator is not responsible for any payment made outside the Platform.

Due diligence

Users are responsible for conducting their own due diligence before entering into any Transaction. The Operator recommends reviewing seller verification badges, communicating through the Platform's messaging system before sharing personal contact details, and inspecting items in person where possible before payment.

Disputes between Users

The Operator is not responsible for resolving disputes between Users. If you have a dispute with another User, you should seek to resolve it directly. The Operator may, at its sole discretion, investigate complaints and take action against accounts found to be in breach of these Terms, but is not obliged to do so.

Fraud

If you believe you have been the victim of fraud on or connected to the Platform, you should report it to safety@listu.co.uk and to Action Fraud (actionfraud.police.uk). Contact your bank immediately if money has been transferred fraudulently.

Intellectual Property

Operator IP

The Platform, including its software, design, branding, trademarks, and content produced by the Operator, is the intellectual property of Valentino Platinum Ltd and is protected by applicable UK and international law. You may not reproduce, distribute, modify, or create derivative works from any Operator IP without prior written permission.

User content

You retain ownership of Content you submit to the Platform, subject to the licence granted in Section 4 of these Terms. You confirm that you own or have the right to use all Content you submit, and that such Content does not infringe the intellectual property rights of any third party.

Third party IP

You must not post Content that infringes the copyright, trademark, or other intellectual property rights of any third party. If you believe Content on the Platform infringes your intellectual property rights, contact legal@listu.co.uk with details of the claimed infringement.

Data and Privacy

The collection, use, storage, and protection of your personal data is governed by the ListU Privacy Policy, available at listu.co.uk/privacy. The Privacy Policy forms part of these Terms of Service.

By using the Platform, you consent to the processing of your personal data as described in the Privacy Policy.

UK GDPR rights

Your rights under the UK General Data Protection Regulation — including rights of access, rectification, erasure, restriction, portability, and objection — are set out in the Privacy Policy and on the Legal Notice page at listu.co.uk/legal-notice. To exercise any data right, contact legal@listu.co.uk.

Limitation of Liability

Platform availability

The Operator does not warrant that the Platform will be available at all times, free from errors, or free from harmful components. Access to the Platform may be interrupted or suspended for maintenance, upgrades, or for reasons beyond the Operator's control.

No warranty on Transactions

The Operator makes no representation or warranty regarding the accuracy, completeness, or quality of any Listing, or the reliability, honesty, or conduct of any User. Users rely on Listings and engage in Transactions at their own risk.

Limitation

To the fullest extent permitted by applicable UK law, the Operator's total liability to any User for any loss or damage arising from use of the Platform — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — is limited to the greater of £100 or the amount paid by you to the Operator in the 12 months preceding the claim.

Exclusions

Nothing in these Terms limits or excludes the Operator's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable UK law.

Consumer rights

If you are a consumer, your statutory rights under the Consumer Rights Act 2015 and other applicable UK consumer protection legislation are not affected by these Terms.

Suspension and Termination

By the User

You may deactivate or request deletion of your account at any time from Settings → Account Management. Deletion requests are processed with a 30-day grace period, during which the request may be cancelled.

By the Operator

The Operator may suspend or terminate your account — and remove any associated Listings and Content — at any time and without prior notice if it reasonably believes you have breached these Terms, engaged in fraudulent or harmful conduct, or for any other reason at its discretion.

Effect of termination

  • Your right to access the Platform ceases immediately upon account termination.
  • Listings associated with the account will be removed.
  • Content licences granted to the Operator under these Terms survive termination.
  • Provisions of these Terms that by their nature should survive termination will do so, including Sections 7, 9, and 11.

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales.

Subject to any mandatory rights you have as a consumer under applicable UK law, any dispute arising out of or in connection with these Terms or your use of the Platform that is not resolved by agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of Scotland or Northern Ireland respectively.

Changes to These Terms

The Operator may update these Terms of Service at any time. Where changes are material, we will provide reasonable notice — which may include displaying a notice on the Platform or sending a notification to registered Users at the email address associated with their account.

Your continued use of the Platform following the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.

The date at the top of this page indicates when these Terms were last updated. Previous versions of the Terms are available on request by contacting legal@listu.co.uk.
